What are the implications of a lawsuit on a rental property?
My parents own a leasing house that they rent out. 2 years ago there was an ancient self who rented with younger family members. The ancient self fell down the stairs and was injured. That family is now suing my parents. The lawsuit will not be settled for at least another 2 years. If my parents try to sell the house before this is resolved, what are the implications for the new buyer of the property with accept to the lawsuit and with accept to the new buyer getting insurance. Will the lawsuit stay on the house or stay on my parents only? Will the new buyer be able to get insurance or will they face restrictions?
It stays with the people named in the case – your parents. The house isn’t a defendant, your parents are.
It stays with the parents. Make sure their insurance company (homeowners and personal liability and commercial liability) are all involved to help with this. If the other party gets a judgement, and the bill is not paid by insurance, they can file a lien against the house and prevent its future sale. But, in all likelihood, if the amount is modest, the insurance company will place forward a settlement to pay for the injuries.
This is really a question for an attorney. Why are you wasting timne here? See an attorney. Now.
The law suit will stay on your parents. The new title-holder won’t have a problem getting insurance. What caused the self to fall? If it was lack of a handrail which is the only reason I can see that the persons suing would win
